     "markdown": "الإرسال لغة مصدر أرسل الشيء: أطلقه وأهمله، ويقال أرسل الكلام أي أطلقه من غير تقييد، وأرسل الرسول: بعثه برسالة، وأرسل عليه شيئا: سلطه عليه. ويستعمل الفقهاء الكلمة بإطلاقات عدة: الإرخاء، كإرسال اليدين في الصلاة وإرسال طرف العمامة؛ والتوجيه، كإرسال مال أو رسالة إلى شخص؛ والتخلية، كإرسال المحرم ما تحت يده من صيد؛ والإهمال، كإرسال الماء والنار والحيوان؛ والتسليط، كإرسال الحيوان أو السهم على الصيد. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2173}\nويستعمل الأصوليون الإرسال في المصلحة المرسلة، وهي كل مصلحة أطلقها الشارع فلم يعتبرها ولم يلغها. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2173}\nفي الحديث يطلق الإرسال عند جمهور المحدثين على ترك التابعي الواسطة بينه وبين النبي، فيرفع الحديث إليه مباشرة بقوله: قال رسول الله كذا، أو فعل كذا، أو فعل بحضرته كذا. وخصه بعضهم برفع التابعي الكبير الذي رأى جماعة من الصحابة وجالسهم. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2173} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2174}\nإذا انقطع الإسناد قبل الوصول إلى التابعي، بأن سقط راو لم يسمع ممن فوقه، فليس بمرسل عند الحاكم وغيره من أهل الحديث، بل يسمى منقطعا إن سقط واحد، ومعضلا إن سقط أكثر. أما عند أهل الأصول فكل ذلك يسمى مرسلا، وهو ما ذهب إليه الخطيب من المحدثين. وجاء في مسلم الثبوت: الأولى تعريفه بأنه ما رواه العدل من غير إسناد متصل ليشمل المنقطع. ويرى الكثيرون أن كثرة هذه الاصطلاحات والأسماء لا فائدة كبيرة فيها. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2174}\nينقسم المرسل عند الأصوليين إلى أربعة أقسام. الأول ما أرسله صحابي، وحكمه القبول بالإجماع لعدالة الصحابة. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2174}\nالثاني إرسال القرنين الثاني والثالث، أي التابعين وأتباعهم. وهو حجة عند الحنفية والمالكية وأشهر روايتي الحنابلة إذا كان المرسل عدلا. أما الشافعي فلا يعتبره حجة إلا إذا تأيد بآية أو سنة مشهورة أو موافقة قياس صحيح أو قول صحابي، أو تلقته الأمة بالقبول، أو اشترك في إرساله عدلان بشيخين مختلفين، أو ثبت اتصاله بوجه آخر، كأن يسنده غير مرسله. ولهذا قبلت مراسيل سعيد بن المسيب، لأنها وجدت بالتتبع مسندة، وأكثرها مما سمعه عن عمر بن الخطاب. وأشهر روايتي أحمد أنه حجة. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2174} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nالثالث ما أرسله العدل من غير القرون الثلاثة، ويعتبره أبو الحسن الكرخي حجة، لأن العلة التي توجب قبول مراسيل القرون الثلاثة، وهي العدالة والضبط، تشمل سائر القرون. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nالرابع ما أرسل من وجه واتصل من وجه آخر، وهو مقبول عند الأكثر، لأن المرسل ساكت عن حال الراوي والمسند ناطق، والساكت لا يعارض الناطق. مثاله حديث «لا نكاح إلا بولي»، رواه إسرائيل بن يونس مسندا ورواه شعبة مرسلا. وقال بعض العلماء لا يقبل، لأن سكوت الراوي عن ذكر شيخه بمنزلة الجرح، وإسناد الآخر بمنزلة التعديل، وإذا اجتمع الجرح والتعديل عمل بالجرح. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nاختلف الفقهاء في وضع اليدين في الصلاة على أربعة أقوال. الأول أن يضع المصلي اليمنى على اليسرى، وهو اختيار جمهور الحنفية والشافعية والحنابلة، وقالوا إنه السنة، واستدلوا بحديث سهل بن سعد في أن الناس أمروا بذلك، وبحديث وائل بن حجر في صفة صلاة النبي، وبحديث ابن مسعود. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nالثاني استحباب الإرسال، أي ترك اليدين مرسلتين، وكراهة القبض في الفرض، وجوازه في النفل؛ وعللت الكراهة بأن القبض اعتماد على اليدين فأشبه الاستناد، وهذا رواية ابن القاسم عن مالك في المدونة، وإليه ذهب خليل وشراحه كالدردير والدسوقي. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nالثالث إباحة القبض في الفرض والنفل، وهو قول مالك في سماع أشهب وابن نافع. والرابع منع القبض فيهما، حكاه الباجي، وقال المسناوي إنه من الشذوذ. وينبغي أن يرسل اليدين برفق عند ابتداء التكبير، ليكون مقارنا للحركة. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2176}\nفي إرسال العذبة من العمامة والتحنيك بها: نقل الحطاب عن ابن الحاج أن العمامة بغير عذبة ولا تحنيك بدعة مكروهة، وأكملها أن يجمع الأمرين. أما النووي فقال: لا كراهة في إرسال العذبة ولا في تركها، وتعقبه ابن أبي شريف بأن الإرسال مستحب وتركه خلاف الأولى. وعند الحنفية يندب إرسال ذنب العمامة بين الكتفين إلى وسط الظهر، وقيل إلى موضع الجلوس، وقيل شبرا. وعند الحنابلة العمامة المحنكة مستحبة وكراهة الصماء. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2176} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nاتفق الفقهاء في الجملة على صحة الإرسال في النكاح وترتب آثاره. فعند الحنفية، إذا أرسل الرجل رسولا إلى امرأة أو كتب إليها: تزوجتك، فقبلت بحضرة شاهدين سمعا كلام الرسول أو قراءة الكتاب، جاز. وإن لم يسمعا لم يجز عند أبي حنيفة ومحمد، وقال أبو يوسف: يجوز إذا قالت المرأة زوجت نفسي، لأن قولها شطر العقد والشهادة على الشطرين شرط. ووافق الشافعية والمالكية والحنابلة أبا حنيفة ومحمدا. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2176} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nإذا تعذر على الخاطب النظر إلى المخطوبة، أجاز المالكية والشافعية والحنابلة أن يرسل امرأة يثق بها لتنظر إليها ثم تصفها له، استدلالا بأن النبي أرسل أم سليم إلى امرأة ليُنظر إليها، وهو حديث رواه الحاكم وصححه. وقال الشبراملسي إن الخبر ليس كالعيان، فلا يكتفى بالوصف بعد الإرسال. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nاتفق الفقهاء على أن الزوج إذا أرسل إلى زوجته كتابا فيه «أنت طالق» طلقت في الحال، وصح الكتاب وإن لم يصل إليها، وتعتبر عدتها من وقت كتابة الكتاب. أما إذا كتب: إذا وصلك كتابي فأنت طالق، فتطلق من تاريخ الوصول، لأن شرط وقوع الطلاق وصول الكتاب إليها. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nاتفق الفقهاء على أن الرسول بالبيع إذا قبل المرسل إليه في المجلس الذي بلغه فيه الكتاب أو كلام الرسول، تم البيع بين المتعاقدين، لأن الرسول سفير ينقل كلام المرسل، فكأنه حضر بنفسه. ويسري هذا الحكم على الإجارة والمكاتبة، إلا أن المالكية يفرقون في ذلك تفريقا لم يتضح تماما في نص الصفحة، فيرجع إليه في الأصل. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nإذا أسند الرسول الشراء إلى نفسه طولب بالثمن، وإذا أقر المرسل بالإرسال كان للبائع أن يطالب أيهما شاء، إلا أن يحلف المرسل أنه دفع الثمن للرسول فيبرأ ويتبع الرسول. وإذا أسنده إلى المرسل لم يطالب الرسول، بل المرسل. وذكر الدردير أن الرسول إذا قال «بعثني فلان لأبيعه كذا» ورضي البائع فلا يطالب الرسول. وأجمع الحنفية على أن الرسول بالشراء لا يملك إبطال الخيار، وأن رؤيته ليست رؤية المرسل، ويثبت الخيار للمرسل إن لم يره. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2178}\nقرر الأئمة أن الشيء المرسل باق على ملك مرسله حتى يقبضه المرسل إليه، فإن لم يقبضه فهو باق على ملك مرسله، ولا يجوز لغيره أخذه مطلقا. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2178}\nإذا زعم شخص أنه مرسل من زيد لاستعارة حلي من بكر فدفعه بكر، ثم زعم الرسول أنه تلف منه، فإن صدقه زيد في الإرسال ضمنه زيد، وإن لم يصدقه حلف أنه لم يرسله وبرئ. والراجح أن الرسول يضمن ولا يبرأ بالحلف إلا ببينة على الإرسال، فالضمان على المرسل. وعند قاضي خان من الحنفية، إذا أرسل الآمر رسولا إلى البزاز ليرسل الثوب، فأرسله البزاز مع رسوله أو مع غيره فتلف قبل الوصول، فلا ضمان على الرسول؛ وإن أرسله البزاز مع رسول الآمر فالضمان على الآمر، لأن رسوله قبض الثوب على المساومة. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2178} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2179}\nوإذا أرسل المودع الوديعة إلى المودع بإذنه صح الإرسال، وإن أرسلها بغير إذنه فتلفت من الرسول ضمنها، إلا إذا عرضت له إقامة طويلة في الطريق، فيجب عليه أن يبعثها إليه، ولا ضمان عليه إن تلفت، وإن كانت الإقامة قصيرة فعليه إبقاؤها، وإن كانت متوسطة خير بين إرسالها وإبقائها. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2180}\nوكذلك وصي رب المال إذا أرسل المال للورثة بغير إذنهم، فإنه يضمن إن ضاع، والقاضي إذا بعث المال لمستحقه بغير إذنه، فالضمان عليه عند ابن القاسم، خلافا لأصبغ. ونقل ابن قدامة عن أحمد أن من أرسل رسولا بقبض دين له، فبعث معه دينارا عوضا عن دراهم، فضاع الدينار، فالضمان على الباعث، لأنه لم يأذن له بالصرف، إلا أن يخبر الرسول الغريم بإذن صاحب الدين فيكون الضمان على الرسول. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2180} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2179}\nأثر الإرسال في قبول الشهادة للمرسل أو عليه: بيّن الكاساني أن من أرسل رسولا إلى امرأة يريد الزواج بها فكتب إليها بذلك، فقبلت بحضرة شاهدين سمعا كلام الرسول أو قراءة الكتاب، جاز، لاتحاد المجلس معنى، لأن كلام الرسول كلام المرسل؛ وإن لم يسمعا فلا يجوز عند أبي حنيفة ومحمد، وعند أبي يوسف يجوز إن قالت المرأة زوجت نفسي. ويؤيد الدسوقي اعتبار الإشهاد في الإرسال: فالمودع يضمن الوديعة إن دفعها إلى الرسول بغير إشهاد، لأنه دفعها إلى غير من ائتمنه، فإن أشهد فقد برئ، ويرجع المرسل إليه على الرسول عند عدم البينة. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2180} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2181}\nثالثا: الإرسال بمعنى الإهمال، وفيه ضمان ما تتلفه الدواب المرسلة. فرّق الشافعية بين الدابة ومعها راكبها أو قائدها، فيضمنها ليلا أو نهارا لأن اليد لهما وفعلها منسوب إليهما، وبين الدابة التي لا راكب معها ولا قائد، فلا ضمان فيما تتلفه نهارا، ويضمن صاحبها ما تتلفه ليلا لتقصيره بإرسالها، على وفق العادة في حفظ الزرع نهارا وحفظ الدابة ليلا، فإن تعودوا العكس انعكس الحكم. واستثنى الشافعية الحمام والنحل ونحوها، فلا ضمان في إتلافها مطلقا. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2181}\nوقد وافق المالكية والحنابلة الشافعية في الضمان ليلا. وفرّق المالكية بحسب الأرض: فإن كانت مزارع وحوائط لا تصلح مكانا للسرح، فلا يجوز إرسال المواشي فيها، وما أفسدته ليلا أو نهارا فعلى أربابها ضمانه؛ وإن جرت عادة الناس بإرسال مواشيهم فيها فلا ضمان على أهلها. أما الحمام والنحل والدجاج فللمالكية روايتان: الأولى توافق الشافعية، والثانية أن حكمها حكم الماشية، وهي رواية ابن القاسم، وصوّب ابن عرفة الأولى. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2182}\nوقال صاحب التاج والإكليل: من أرسل في أرضه نارا أو ماء فوصل إلى أرض جاره فأتلف زرعه، فالنظر إلى قرب الأرض وبعدها؛ فإن كانت قريبة فعليه الضمان، وإن كانت بعيدة فلا ضمان إلا أن تصل النار بسبب ريح أو نحوه. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2182}\nوفرّق الحنفية بين الدابة والكلب عند الإرسال: فإذا أرسل الكلب ولم يكن سائقا له فلا ضمان فيما يتلفه، لأنه غير متعد ولا يمكنه اتباعه؛ وإذا أرسل الدابة فأتلفت مالا على الفور فعليه الضمان، لأنه متعد بإرسالها مع إمكان اتباعها، إلا أن أبا يوسف لم يفرق في ذلك. وجاء في الدر المختار أن من أرسل طيرا أو دابة أو كلبا ولم يسقه، أو انفلتت دابة بنفسها، فلا ضمان في الكل نهارا أو ليلا، لقول النبي: «العجماء جبار»، أي أن المنفلتة هدر. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2182}\nأما الماء فالحكم يختلف بحاله وطبيعة الأرض: فمن أرسل ماء في أرضه فخرج إلى أرض غيره، فإن كانت أرضه تحتمله فلا ضمان عليه، وإن أرسل ما لا تحتمله ضمن. ومن طرح ترابا في النهر فمنع الماء فغرق قصرا، فالضمان على الطارح لا على المرسل، لأنه متعد. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2182} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2183}\nواستدل الحنابلة بما رواه مالك عن الزهري عن حرام بن سعد بن محيصة: أن ناقة للبراء دخلت حائط قوم فأفسدت، فقضى النبي بأن على أهل الأموال حفظها بالنهار، وما أفسدته ليلا فهو مضمون عليهم. وقيّد الحنابلة الحكم بالمواضع التي فيها زرع ومراعٍ، ولا يجوز إرسال الدابة فيما لا مرعى فيه بغير حافظ. وخالف الحارثي من الحنابلة المالكية فاعتبر العادة، فيكون الضمان على مالك الدابة فيما أفسدته ليلا إن فرط في حفظها. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2183}\nوقال الحنابلة إن من أرسل صيدا وقال «أعتقتك» لم يزل ملكه عنه، كما لو أرسل البعير والبقرة من البهائم المملوكة، لأن الملك لا يزول بذلك. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2183}\nالإرسال في القبض والعزل: قال السرخسي إن من اشترى شيئا ثم أرسل رسولا يقبضه فله الخيار إذا رآه، لأن رؤية الرسول وقبضه لا يلزمان المرسل المتاع، فالمقصود علم العاقد بأوصاف المعقود عليه. فإن وكّل وكيلا بالقبض فرآه وقبضه، فلا خيار للموكل عند أبي حنيفة؛ وقال أبو يوسف ومحمد: له الخيار، لأن القبض فعل والرسول والوكيل فيه سواء. وحجة أبي حنيفة أن التوكيل بمطلق القبض يثبت للوكيل ولاية إتمامه، وتمامه لا يكون إلا بعد تمام الصفقة، أما الرسول فليس إليه إلا تبليغ الرسالة، واستدل بآية في سورة الأنعام (66) تنفي عن النبي الوكالة وتثبت له الرسالة. وخيار العيب لا يسقط بقبض الوكيل. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2183} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2184}\nولو أرسل إلى وكيله رسولا بعزله فبلغه الرسالة، انعزل الوكيل، عدلا كان الرسول أو غير عدل، صغيرا أو كبيرا، لأن الرسول قائم مقام المرسل ومعبّر عنه. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2184}\nالرجوع عن الإرسال: يرى الحنفية أن للمرسل أن يرجع عما أرسل به، لأن الرسالة لا تكون مشافهة فتحتمل الرجوع، سواء علم الرسول أم لم يعلم، بخلاف الوكيل فلا يصح عزله بغير علمه. وروى ابن حجر الهيثمي عن ابن سريج أن من أرسل صدقة مع رسوله ثم استردها من الطريق فله ذلك، وإن مات المرسل قبل وصولها كانت تركة لورثته. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2184}\nالإرسال بمعنى التسليط: إرسال كلب الصيد أو الحيوان المعلَّم، فإن انطلق وراء الصيد بإرسال صاحبه ووقف بأمره، فالصيد مباح الأكل ولو لم تدرك ذكاته. أما إذا انطلق الحيوان بنفسه فصاد، فلا يؤكل إلا إذا أدركت تذكيته، لأنه صاده لنفسه لا لصاحبه. وتفصيل أحكام الصيد في مصطلحه. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2184} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2185}\nالإرسال بمعنى التخلية: اتفق الفقهاء على وجوب إرسال الصيد الذي في يد المحرم إن كان معه قبل الإحرام، وكذلك غير المحرم إذا صاده في الحل ودخل به الحرم. أما الصيد في بيت المحرم أو في قفص معه فلا يجب إرساله، خلافا للحنفية في الصحيح عندهم. وذكر صاحب الهداية من الحنفية رأيا مخالفا، لأن الصحابة أحرموا وفي بيوتهم صيود ودواجن ولم ينقل إرسالها، ثم قال إن كان القفص في يده لزمه إرساله على وجه لا يضيع، كأن يخليه في بيته، لأن إضاعة المال منهي عنها. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2185}"

     "heading": "Irsal (sending, letting go)",
     "markdown": "Irsal in the lexicon is the verbal noun of arsala: to let a thing go and leave it, to speak without restriction, to send a messenger with a message, or to set something on something. The jurists use the word in several senses: letting hang (the hands in prayer, the end of a turban), sending (money or a message to someone), leaving (a sacred-state person releasing game in hand), neglect (water, fire or animals let loose), and empowering (releasing an animal or arrow against game). {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2173}\nThe usuliyyun use irsal for the unrestricted benefit (al-maslaha al-mursala), meaning any benefit the lawgiver neither required nor disregarded. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2173}\nIn hadith, most scholars use irsal for a Successor who omits the companion between himself and the Prophet and reports directly, \"the Messenger of God said\" or \"did\" such and such. Some limit it to a senior Successor who saw several companions and sat with them. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2173} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2174}\nWhen the chain breaks before the Successor, through a narrator who did not hear from the one above him, al-Hakim and other hadith scholars do not call it mursal: it is munqati' if one link is missing and mu'dal if more are. For the usuliyyun all of these are mursal. Al-Khatib among the hadith scholars takes this view. Musallam al-Thubut prefers a definition as what a just narrator reports without a connected chain, which includes the munqati'. Many feel that the multiplicity of these terms has little benefit. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2174}\nThe usuliyyun divide mursal into four kinds. The first, sent by a companion, is accepted by consensus for the justice of the companions. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2174}\nThe second, from the second and third centuries (the Successors and their followers), is a proof for the Hanafis, Malikis and the better-known Hanbali report when the sender is just. Al-Shafi'i accepts it only when supported by a verse, a well-known sunna, a sound analogy, a companion's word, the community's acceptance, two just narrators who sent it from different teachers, or a connection proven another way, as when another route narrates it connected. On this basis the mursal of Sa'id ibn al-Musayyib was accepted, because tracing showed most of it connected, and most of it was what he heard from Umar. The better-known of Ahmad's two reports makes it a proof. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2174} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nThe third is a mursal by a just narrator from outside the three centuries. Abu al-Hasan al-Karkhi accepts it, since the cause that makes the mursal of the three centuries acceptable, justice and precision, applies in every age. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nThe fourth is a report sent by one route and connected by another. Most accept it, because the mursal is silent about the narrator and the connected report speaks, and silence does not oppose speech; the example is \"no marriage without a guardian\", which Israil ibn Yunus narrated connected and Shu'ba narrated sent. Some reject it: the silence about a teacher is like a criticism and the other chain like a commendation, and when criticism and commendation meet the criticism prevails. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nOn the placing of the hands in prayer the scholars give four views. The first is that the worshipper places his right hand on his left; this is the choice of the majority of Hanafis, Shafi'is and Hanbalis, and a report of Mutarrif and Ibn al-Majishun from Malik, who call it the sunna. They cite the report of Sahl ibn Sa'd that people were ordered to place the right hand on the left forearm, Wa'il ibn Hujr's description of the Prophet's prayer, and Ibn Mas'ud's account of the Prophet taking his right hand and placing it on his left. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nThe second recommends letting the hands hang, dislikes clasping them in an obligatory prayer and allows it in a voluntary one; some say this without limit and some say it only when prolonged. This is the report of Ibn al-Qasim from Malik in the Mudawwana, taken by Khalil and his commentators al-Dardir and al-Dusuqi, whose reason for the dislike is that clasping resembles leaning. Al-Dardir adds that one who clasps not for leaning but for support is not disliked, and that the reason is the sound basis, so clasping is allowed absolutely in voluntary prayer. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nThe third allows clasping in both obligatory and voluntary prayer, a view of Malik in the reports of Ashhab and Ibn Nafi'. The fourth forbids it in both, as al-Baji reported and Ibn Arafa followed; al-Mansawi calls this an anomaly. The hands should be let down gently at the start of the takbir so that the letting down matches the movement. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2176}\nOn the tail of a turban and tying it under the chin, al-Hattab quotes Ibn al-Hajj that a turban without a tail or a chin-tie is a reprehensible innovation, and that doing both is most perfect. Al-Nawawi said there is no reprehensibility in letting the tail hang or not; Ibn Abi Sharif objected that letting it hang is recommended and leaving it is contrary to the preferred course. The Hanafis recommend letting the tail hang between the shoulders to the middle of the back, some say to the place of sitting, others one span. The Hanbalis hold the chin-tied turban recommended and dislike a wrapping without an end. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2176} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nIn marriage, the jurists agree in general that sending a contract by a messenger or in writing is valid and carries its effects. The Hanafis hold that if a man sends a messenger to a woman, or writes to her \"I have married you\", and she accepts before two witnesses who heard the messenger's words or the reading of the letter, it is valid; if they did not hear it, it is invalid according to Abu Hanifa and Muhammad. Abu Yusuf holds it valid if the woman says \"I have given myself in marriage\", because her words are one half of the contract and testimony is required for both halves. The Shafi'is, Malikis and Hanbalis agree with Abu Hanifa and Muhammad. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2176} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nIf a suitor cannot look at the woman he proposes to, the Malikis, Shafi'is and Hanbalis allow him to send a trusted woman to look at her and describe her, citing a report that the Prophet sent Umm Sulaym to a woman with instructions to look at her; al-Hakim reported it and graded it sound. Al-Shabramallisi added that a description is not like seeing, so one should not rely on it after sending. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nThe jurists agree that if a husband sends his wife a letter containing \"you are divorced\", she is divorced at once, whether or not the letter reaches her, and her waiting period is counted from the writing. If he writes \"if my letter reaches you, you are divorced\", the divorce takes effect from the date of its arrival, since arrival is the condition. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nThe jurists agree that if someone sends a messenger or a letter asking another to sell him something, and the addressee accepts within the session in which the letter or the messenger's words reach him, the sale is concluded, because the messenger is an envoy who conveys the sender's words, as though the sender was present. The same rule applies to hire and to manumission by contract (mukataba). The Malikis draw a distinction here that the scanned page does not state fully, and it should be checked in the original. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nIf the messenger attributes the purchase to himself, he is held to the price. If the sender acknowledges that he sent him, the seller may claim from either, unless the sender swears that he paid the messenger, in which case he is discharged and the seller pursues the messenger. If the purchase is attributed to the sender, the sender pays and the messenger does not. Al-Dardir says that when the messenger says \"so-and-so sent me to sell this for a hundred\", and the seller agrees, the messenger is not pursued. The Hanafis agree that a messenger buying does not have power to cancel the option, that his seeing the goods is not the sender's seeing, and that the option stays with the sender if he has not seen them. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2178}\nThe jurists hold that a thing sent remains the property of the sender until the addressee takes possession; until then it stays in the sender's ownership and no one but the one designated may take it. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2178}\nIf a man claims to be sent by Zayd to borrow jewelry from Bakr, Bakr hands it over, and the messenger then claims it was lost, al-Dardir says that Zayd is liable if he confirms the sending; if he denies it he swears and is discharged, and the messenger swears that he was sent and that the loss was without his negligence, and is also discharged; the jewelry is then lost unpaid. The sounder view is that the messenger is liable and is not discharged by oath unless there is evidence of the sending, so the liability then falls on the sender. The Hanafi Qadi Khan says that if a man sends a messenger to a cloth-seller for a cloth and the seller sends it with his own messenger or another, and it is lost before reaching the sender, the sender's messenger is not liable; if the seller sends it with the sender's messenger, the liability falls on the sender, because the messenger took it on the terms of bargaining. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2178} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2179}\nWhere a depositor sends the deposit to its owner with the owner's permission, the sending is valid. If he sends it without permission and it is lost with the messenger, he must pay, except in one case: if he faces a long stay on the road, as a year, he must send it to the owner and is not liable if it is lost, while if he withholds it he is liable. If the stay is short, as days, he must keep it with him, and if he sends it without permission he is liable for its loss. If the stay is middling, as two months, he may send it or keep it, and he is not liable whether he sends it and it is lost or keeps it. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2180}\nThe same rule holds for the guardian of the property owner, who is liable if he sends the property to the heirs without their permission and it is lost; and for the judge who sends property to its entitled person without permission, who is liable according to Ibn al-Qasim, against Asbagh. Ibn Qudama reports Ahmad on a man owed dirhams who sent a messenger to collect them and sent a dinar in their place: the loss falls on the sender, since he did not authorise an exchange, unless the messenger told the debtor that the owner had permitted the dinar, in which case the messenger bears the loss. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2180} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2179}\nOn the testimony that the sending affects: al-Kasani says that if a man sends a messenger to a woman he wants to marry, or writes to her, and she accepts before two witnesses who heard the messenger's words or the reading of the letter, it is valid, because the session is one in meaning and the messenger's words are the sender's words. If they did not hear, it is invalid for Abu Hanifa and Muhammad; for Abu Yusuf it is valid if the woman says \"I have given myself in marriage\". Al-Dasuqi supports requiring witnesses in sending: a depositor who hands the deposit to a messenger without witnesses is liable, since he handed it to someone other than the one he was trusted with; if he had witnesses he is discharged, and the addressee claims from the messenger when there is no proof. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2180} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2181}\nThird, irsal in the sense of neglect: the liability for damage by sent animals. The Shafi'is distinguish an animal with a rider or driver, which is liable by night or day because the hand is theirs and the act is attributed to them, from one with neither, which is not liable for damage by day, while its owner is liable for damage by night because he was negligent in sending it, following a sound report in Abu Dawud and the custom of guarding crops by day and animals by night; if custom is reversed, the ruling reverses. The Shafi'is exempt pigeons, bees and the like from liability altogether. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2181}\nThe Malikis and Hanbalis agree with the Shafi'is on liability by night, with differences in detail. The Malikis divide by land: where there are fields and orchards that are not grazing land, animals may not be sent there, and their owners are liable for damage by night or day; where people customarily send their animals there, the owners are not liable. For pigeons, chickens and bees the Malikis have two reports: one agrees with the Shafi'is, and one treats them like livestock, the view of Ibn al-Qasim, though Ibn Arafa preferred the first. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2182}\nThe author of al-Taj wa al-Iklil says that if a man sends fire or water on his land and it reaches a neighbour's land and damages the crop, one looks at the nearness of the land: if it is near he is liable; if far, he is not, unless the fire reached it by wind or the like. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2182}\nThe Hanafis distinguish a dog from an animal when sent: a dog sent without a driver causes no liability for what it damages, since the sender is not a transgressor and cannot follow it; an animal sent that damages property at once makes him liable, since he transgresses by sending it on the road when he could follow it, though Abu Yusuf makes no distinction. The Durr al-Mukhtar says that whoever sends a bird, an animal or a dog without driving it, or whose loose animal escapes on its own, is not liable for the damage by day or night, since the loose animal's damage is wasted, according to the saying that the loose beast is wasted. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2182}\nWater depends on its quantity and the land: whoever sends water on his land that flows to another's land is not liable if his land could hold it, and is liable if he sent more than it could hold. Whoever throws earth into a river, so that the water is held back and drowns a house, is liable; the sender is not, since he did not transgress. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2182} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2183}\nThe Hanbalis rely on a report of Malik from al-Zuhri from Haram ibn Sa'd ibn Muhayyisa: a camel of al-Bara' entered a people's enclosure and damaged it, and the Prophet ruled that the owners of property must guard it by day, and what is damaged by night is their liability. The Hanbalis confine this to places with crops and pasture; where there is no pasture, one may not send an animal without a guard. Al-Harithi, a Hanbali, takes custom into account, so the owner is liable for night damage if he was negligent in guarding. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2183}\nThe Hanbalis hold that if a man sends a game animal and says \"I have freed you\", his ownership does not end, as with a camel or cow he sends, since ownership is not ended by that. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2183}\nIrsal in taking delivery and in dismissal: al-Sarakhsi says that a man who buys a thing and sends a messenger to receive it has the option when he sees it, since the messenger's seeing and receipt do not bind the sender to the goods, the aim being that the contracting party know the features of what he contracts for. If he appoints an agent for receipt and the agent sees and receives it, Abu Hanifa gives the principal no option; Abu Yusuf and Muhammad give him the option, since receipt is an act and the messenger and agent are equal in it. Abu Hanifa's argument is that authority to receive in general gives the agent power to complete the receipt, which is only complete after the bargain is complete, whereas the messenger has only to convey the message; he cites a verse of surat al-An'am (66) that denies the Prophet agency while affirming his message. The option for a defect is not lost by an agent's receipt. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2183} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2184}\nIf a man sends a messenger to his agent to dismiss him, and the messenger delivers it, the agent is dismissed, whether the messenger is just or not, young or old, since the messenger stands in the sender's place and speaks for him. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2184}\nRevoking a sending: the Hanafis hold that the sender may revoke what he sent, because a message is not spoken face to face and so can be revoked, whether or not the messenger knows; unlike an agent, whose dismissal without his knowledge is not valid. Ibn Hajar al-Haytami reports from Ibn Surayj that whoever sends charity with a messenger and takes it back on the road may do so, and if he dies before it arrives it is his estate for his heirs. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2184}\nIrsal in the sense of setting on: a trained hunting dog, or a similarly trained animal, that runs after game on its owner's sending and stops at his command, makes the game lawful to eat even without slaughter reached in time; but if the animal runs of its own accord and hunts, the game is not eaten unless the slaughter is completed, since it hunted for itself and not for its owner. Hunting rules are in their own entry. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2184} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2185}\nIrsal in the sense of releasing: the jurists agree that a person in the state of ihram must release a game animal that is in his hand if he had it before entering the state, and likewise a non-pilgrim who hunted in the lawful area and entered the sacred precinct with it. Game kept in the house, or in a cage with him, need not be released, although the Hanafis hold the sound view differs. Al-Hidaya, a Hanafi work, takes a different view: the Companions entered ihram with game and fowl in their houses and it is not reported that they released them; it adds that if the cage is in his hand he must release it in a way that does not waste it, such as by leaving it in his house, since wasting property is forbidden. {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2185}"

     "markdown": "ارسال لغت میں ارسل الشیء کا مصدر ہے: کسی چیز کو چھوڑ دینا اور نظرانداز کرنا، بغیر قید کے کلام کرنا، پیغامبر بھیجنا، یا کسی چیز کو کسی پر مسلط کرنا۔ فقہاء اس لفظ کو کئی معنوں میں استعمال کرتے ہیں: لٹکانا (نماز میں ہاتھ، عمامے کا پلو)، بھیجنا (کسی کو مال یا پیغام)، چھوڑنا (شکار کا جانور چھوڑنا)، بے پروائی (پانی، آگ یا جانور کو کھلا چھوڑنا)، اور مسلط کرنا (جانور یا تیر کو شکار پر چھوڑنا)۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2173}\nاصولیین ارسال کو مصلحت مرسلہ کے لیے استعمال کرتے ہیں، یعنی وہ مصلحت جسے شارع نے نہ معتبر ٹھہرایا نہ باطل۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2173}\nحدیث میں جمہور محدثین کے نزدیک ارسال وہ ہے کہ تابعی اپنے اور نبی کے درمیان صحابی کو چھوڑ دے اور براہ راست کہے: رسول اللہ نے یہ فرمایا یا یہ کیا۔ بعض نے اسے بڑے تابعی تک محدود کیا ہے جس نے کئی صحابہ کو دیکھا اور ان کی مجلس پائی۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2173} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2174}\nاگر سند تابعی تک پہنچنے سے پہلے ٹوٹ جائے، یعنی کوئی راوی ایسا ہو جس نے اپنے اوپر والے سے نہ سنا ہو، تو حاکم اور دیگر محدثین اسے مرسل نہیں کہتے، بلکہ ایک راوی ساقط ہو تو منقطع، اور زیادہ ہوں تو معضل کہلاتا ہے۔ اصولیین کے نزدیک یہ سب مرسل ہیں، اور خطیب نے یہی رائے اختیار کی۔ مسلم الثبوت میں ہے کہ بہتر تعریف یہ ہے کہ وہ روایت جو عادل راوی نے بغیر متصل سند کے کی ہو، تاکہ منقطع بھی شامل ہو۔ بہت سے علماء کے نزدیک ان اصطلاحات اور ناموں کا فائدہ کم ہے۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2174}\nاصولیین کے نزدیک مرسل کی چار قسمیں ہیں۔ پہلی وہ جو صحابی نے مرسل کی ہو، جس کا قبول کرنا صحابہ کی عدالت کے اجماع سے ہے۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2174}\nدوسری دوسری اور تیسری صدی کے تابعین اور ان کے تبع تابعین کا ارسال ہے۔ حنفیہ، مالکیہ اور حنابلہ کی مشہور روایت کے نزدیک، اگر مرسل عادل ہو تو حجت ہے۔ امام شافعی اسے اس وقت تک حجت نہیں مانتے جب تک قرآن، مشہور سنت، صحیح قیاس، صحابی کے قول کی تائید نہ ہو، یا امت نے اسے قبول نہ کیا ہو، یا دو عادل راویوں نے مختلف شیوخ سے اسے مرسل کیا ہو، یا دوسرے طریق سے اس کا اتصال ثابت ہو۔ اسی بنا پر سعید بن المسیب کے مراسیل قبول ہوئے، کیونکہ تتبع سے ان کی اکثریت مسند پائی گئی اور زیادہ تر وہ تھی جو انہوں نے عمر بن الخطاب سے سنی۔ احمد کی مشہور روایت میں یہ حجت ہے۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2174} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nتیسری قسم تین صدیوں کے علاوہ کسی عادل کا مرسل ہے۔ ابو الحسن کرخی اسے حجت مانتے ہیں، کیونکہ تین صدیوں کے مراسیل کی علت یعنی عدالت اور ضبط ہر دور میں موجود ہے۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nچوتھی قسم وہ روایت ہے جو ایک طریق سے مرسل اور دوسرے سے متصل ہو۔ اکثر علماء اسے قبول کرتے ہیں، کیونکہ مرسل راوی کے حال پر خاموش ہے اور متصل بولتی ہے، اور خاموشی بولنے والے کا مقابلہ نہیں کرتی۔ مثال: «لا نکاح إلا بولي»، جسے اسرائیل بن یونس نے متصل اور شعبہ نے مرسل روایت کیا۔ بعض علماء اسے رد کرتے ہیں، کیونکہ شیخ کا ذکر چھوڑنا جرح کی مانند ہے اور دوسری سند تعدیل کی مانند، اور جب جرح و تعدیل جمع ہوں تو جرح پر عمل ہوگا۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nنماز میں ہاتھ باندھنے کے بارے میں علماء کی چار رائیں ہیں۔ پہلی یہ کہ دایاں ہاتھ بائیں پر رکھا جائے؛ یہ جمہور حنفیہ، شافعیہ اور حنابلہ کا انتخاب ہے، اور مطرف اور ابن الماجشون کی مالک سے روایت ہے، اور اسے سنت کہا گیا۔ دلیل میں سہل بن سعد کی روایت ہے کہ لوگوں کو حکم دیا جاتا تھا، وائل بن حجر کی نبی کی نماز کی کیفیت، اور ابن مسعود کی روایت کہ نبی نے ان کا دایاں ہاتھ پکڑ کر بائیں پر رکھا۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nدوسری رائے ہاتھ لٹکانے کو مستحب، فرض نماز میں باندھنے کو مکروہ، اور نفل میں جائز کہتی ہے؛ کہا گیا کہ یہ مطلقاً ہے، اور کہا گیا کہ یہ اس وقت ہے جب طویل ہو۔ یہ ابن القاسم کی مالک سے مدونہ میں روایت ہے، اور خلیل اور ان کے شارحین دردیر اور دسوقی نے اسی کو اختیار کیا۔ کراہت کی علت یہ دی گئی کہ باندھنا ٹیک لگانے کے مشابہ ہے؛ دردیر کے مطابق جو سہارے کے لیے نہ کہ ٹیک کے لیے باندھے تو مکروہ نہیں، اور یہی علت معتمد ہے، اس لیے نفل میں بغیر ضرورت کے ٹیک کی اجازت کی بنا پر مطلقاً جائز ہے۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175}\nتیسری رائے فرض اور نفل دونوں میں باندھنے کی اجازت دیتی ہے، جو مالک کا قول اشہب اور ابن نافع کی سماع میں ہے۔ چوتھی دونوں میں منع کرتی ہے، جسے باجی نے نقل کیا اور ابن عرفہ نے اس کی پیروی کی، مگر مسناوی نے اسے شذوذ کہا۔ ہاتھ تکبیر کے وقت نرمی سے چھوڑنے چاہئیں تاکہ حرکت کے ساتھ ہوں۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2175} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2176}\nعمامے کے پلو کو لٹکانے اور اسے ٹھوڑی کے نیچے سے باندھنے کے بارے میں حطاب نے ابن الحاج سے نقل کیا کہ بغیر پلو اور بغیر ٹھوڑی کے بندھا عمامہ مکروہ بدعت ہے، اور کامل وہ ہے جو دونوں کو جمع کرے۔ نووی نے کہا کہ پلو لٹکانے اور نہ لٹکانے میں کراہت نہیں، جس پر ابن ابی شریف نے کہا کہ لٹکانا مستحب ہے اور چھوڑنا خلاف اولیٰ ہے۔ حنفیہ کے نزدیک پلو کندھوں کے درمیان سے کمر کے درمیان تک لٹکانا مستحب ہے، بعض کے نزدیک بیٹھنے کی جگہ تک، اور بعض کے نزدیک ایک بالشت۔ حنابلہ کے نزدیک ٹھوڑی کے نیچے سے باندھا ہوا عمامہ مستحب ہے اور بغیر پلو کا لپیٹا ہوا عمامہ مکروہ۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2176} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nنکاح میں فقہاء بالجملہ اس پر متفق ہیں کہ پیغامبر یا خط کے ذریعے عقد صحیح ہے اور اس کے اثرات مرتب ہوتے ہیں۔ حنفیہ کے نزدیک اگر مرد کسی عورت کو پیغامبر بھیجے یا لکھے کہ میں نے تم سے نکاح کیا، اور عورت دو گواہوں کے سامنے قبول کرے جنہوں نے پیغامبر کی بات یا خط پڑھے جانے کو سنا، تو جائز ہے؛ اور اگر نہ سنیں تو ابو حنیفہ اور محمد کے نزدیک ناجائز ہے۔ ابو یوسف کے نزدیک جائز ہے اگر عورت کہے کہ میں نے اپنا نکاح کیا، کیونکہ اس کا قول عقد کا ایک حصہ ہے اور گواہی دونوں حصوں پر شرط ہے۔ شافعیہ، مالکیہ اور حنابلہ ابو حنیفہ اور محمد کے ساتھ ہیں۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2176} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nاگر خاطب مخطوبہ کو دیکھ نہ سکے تو مالکیہ، شافعیہ اور حنابلہ جائز کہتے ہیں کہ کسی قابل اعتماد عورت کو بھیجے جو اسے دیکھ کر بیان کرے، اس روایت کی بنا پر کہ نبی نے ام سلیم کو ایک عورت کی طرف بھیجا کہ اسے دیکھیں؛ حاکم نے اسے روایت کرکے صحیح کہا۔ شبراملسی نے کہا کہ وصف دیکھنے کی طرح نہیں، اس لیے بھیجنے کے بعد اس پر اکتفا نہ ہو۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nطلاق میں فقہاء متفق ہیں کہ شوہر خط میں «تم طلاق والی ہو» لکھ کر بھیجے تو عورت فوراً طلاق والی ہو جاتی ہے، خواہ خط پہنچے یا نہ پہنچے، اور عدت خط لکھنے کے وقت سے شمار ہوگی۔ اگر لکھے کہ «اگر میرا خط تمہیں پہنچے تو تم طلاق والی ہو» تو طلاق پہنچنے کی تاریخ سے ہوگی، کیونکہ وقوع کی شرط خط کا پہنچنا ہے۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nفقہاء متفق ہیں کہ اگر کوئی پیغامبر یا خط کے ذریعے کسی سے سودا مانگے اور مخاطب اسی مجلس میں قبول کرے جس میں خط یا پیغامبر کی بات پہنچی، تو سودا ہو جاتا ہے، کیونکہ پیغامبر ایلچی ہے جو بھیجنے والے کی بات پہنچاتا ہے، گویا وہ خود موجود تھا۔ یہی حکم اجارہ اور مکاتبت پر جاری ہوتا ہے، البتہ مالکیہ یہاں ایک تفریق کرتے ہیں جس کی تفصیل اسکین شدہ صفحے میں مکمل واضح نہیں، اس لیے اصل کی طرف رجوع کیا جائے۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2177}\nاگر پیغامبر خود کو خریدار قرار دے تو ثمن کا مطالبہ اسی سے ہوگا۔ اگر بھیجنے والا اقرار کرے کہ اس نے بھیجا تھا تو بیچنے والا جس سے چاہے مطالبہ کر سکتا ہے، سوائے اس کے کہ بھیجنے والا قسم کھائے کہ اس نے پیغامبر کو ثمن دیا ہے، تو وہ بری ہو جائے گا اور مطالبہ پیغامبر سے ہوگا۔ اگر خرید کی نسبت بھیجنے والے کی طرف ہو تو ثمن اسی کے ذمے ہوگا، پیغامبر کے ذمے نہیں۔ دردیر کے مطابق اگر پیغامبر کہے کہ فلاں نے مجھے بھیجا کہ یہ چیز سو میں بیچوں اور بیچنے والا راضی ہو تو پیغامبر سے مطالبہ نہیں۔ حنفیہ کا اجماع ہے کہ پیغامبر خریدار ہو تو اسے خیار ساقط کرنے کا اختیار نہیں، اور اس کا دیکھنا بھیجنے والے کا دیکھنا نہیں، اور اگر بھیجنے والے نے سامان نہ دیکھا ہو تو خیار اس کے لیے باقی رہتا ہے۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2178}\nائمہ نے قرار دیا کہ بھیجی ہوئی چیز اس وقت تک بھیجنے والے کی ملکیت میں رہتی ہے جب تک مرسل الیہ اس پر قبضہ نہ کرے، اور کسی دوسرے کے لیے اسے لینا مطلقاً جائز نہیں۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2178}\nاگر کوئی شخص دعویٰ کرے کہ زید نے اسے بکر سے زیور مانگنے بھیجا ہے، بکر دے دے، پھر پیغامبر کہے کہ وہ ضائع ہو گیا، تو دردیر کے مطابق زید ضامن ہوگا اگر وہ بھیجنے کی تصدیق کرے؛ ورنہ وہ قسم کھا کر بری ہوگا اور پیغامبر بھی قسم کھا کر بری ہوگا، اور زیور ضائع ہو گیا۔ راجح یہ ہے کہ پیغامبر ضامن ہے، قسم سے بری نہیں ہوتا جب تک بھیجنے پر گواہی نہ ہو، تو ضمان بھیجنے والے پر ہے۔ قاضی خان کے مطابق اگر کوئی شخص کپڑا خریدنے کے لیے کپڑے والے کے پاس پیغامبر بھیجے، اور کپڑے والا وہ پیغامبر کے ساتھ یا کسی اور کے ذریعے بھیجے اور وہ راستے میں ضائع ہو جائے تو پیغامبر ضامن نہیں؛ اور اگر کپڑے والا بھیجنے والے کے پیغامبر کے ساتھ بھیجے تو ضمان بھیجنے والے پر ہے، کیونکہ اس کے پیغامبر نے سودے کی شرط پر کپڑا لیا تھا۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2178} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2179}\nاگر امانت رکھنے والا امانت مالک کو مالک کی اجازت سے بھیجے تو ارسال صحیح ہے۔ اگر بغیر اجازت بھیجے اور پیغامبر کے پاس ضائع ہو جائے تو وہ ضامن ہوگا، سوائے اس صورت کے کہ راستے میں طویل قیام پیش آ جائے، جیسے ایک سال، تو اس پر لازم ہے کہ اسے مالک تک بھیجے اور ضائع ہونے پر ضامن نہیں ہوگا، اور اگر روکے رکھے تو ضامن ہوگا۔ قیام مختصر ہو، جیسے چند دن، تو اس کے پاس رکھنا لازم ہے اور بغیر اجازت بھیجنے پر تلف ہونے کا ضامن ہوگا۔ قیام درمیانہ ہو، جیسے دو ماہ، تو بھیجنے اور روکنے کا اختیار ہے، بھیجنے کی صورت میں تلف ہو تو ضامن نہیں۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2180}\nیہی حکم مال کے مالک کے وصی پر ہے کہ وہ مال ورثاء کو بغیر اجازت بھیجے تو ضائع ہونے پر ضامن ہوگا؛ اور قاضی اگر حقدار کو بغیر اجازت مال بھیجے تو ابن القاسم کے نزدیک ضمان اسی پر ہے، اصبغ کے خلاف۔ ابن قدامہ نے احمد سے نقل کیا کہ جس کا کسی کے ذمے دراہم تھے، اس نے پیغامبر کو وصول کرنے بھیجا اور اس کے ساتھ دراہم کی جگہ ایک دینار بھیجا، تو دینار کا ضمان بھیجنے والے پر ہوگا کیونکہ اس نے تبدیلی کی اجازت نہیں دی، الا یہ کہ پیغامبر مقروض کو بتا دے کہ صاحبِ دین نے دینار لینے کی اجازت دی ہے، تو پھر ضمان پیغامبر پر ہوگا۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2180} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2179}\nپیغامبر کے ذریعے گواہی کا اثر: کاسانی کے مطابق اگر کوئی شخص کسی عورت کے پاس پیغامبر بھیجے یا خط لکھے کہ میں تم سے نکاح چاہتا ہوں، اور عورت دو گواہوں کے سامنے قبول کرے جنہوں نے پیغامبر کی بات یا خط پڑھا جانا سنا، تو جائز ہے کیونکہ مجلس معنی میں ایک ہے اور پیغامبر کی بات مرسل کی بات ہے؛ اگر وہ نہ سنیں تو ابو حنیفہ اور محمد کے نزدیک ناجائز ہے، اور ابو یوسف کے نزدیک جائز ہے اگر عورت کہے کہ میں نے اپنا نکاح کیا۔ دسوقی بھی ارسال میں گواہی کے اعتبار کی تائید کرتے ہیں: امانت رکھوانے والا امانت پیغامبر کے ہاتھ بغیر گواہی کے دے تو ضامن ہوگا، کیونکہ اس نے امین کے سوا کسی اور کو دی؛ گواہی کے ساتھ دے تو بری ہے، اور بینہ نہ ہو تو مرسل الیہ پیغامبر سے وصول کرے گا۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2180} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2181}\nتیسرا معنی: ارسال بمعنی غفلت، یعنی چھوڑے ہوئے جانوروں کا ضمان۔ شافعیہ اس جانور میں فرق کرتے ہیں جس کے ساتھ سوار یا ہانکنے والا ہو، وہ دن رات ضامن ہے کیونکہ ہاتھ اس کا ہے اور فعل اس کی طرف منسوب ہے، اور جس کے ساتھ نہ سوار ہو نہ ہانکنے والا، وہ دن کے نقصان کا ضامن نہیں، اور رات کے نقصان کا ضامن اس کا مالک ہے کیونکہ اس نے چھوڑنے میں کوتاہی کی، ابو داؤد کی روایت اور عادت کے مطابق کہ کھیت دن میں اور جانور رات میں محفوظ رکھے جائیں؛ عادت الٹ ہو تو حکم الٹ جاتا ہے۔ شافعیہ کبوتر، شہد کی مکھی وغیرہ کو بالکل ضمان سے مستثنیٰ کرتے ہیں۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2181}\nمالکیہ اور حنابلہ رات کے ضمان میں شافعیہ کے ساتھ ہیں، تفصیل میں اختلاف ہے۔ مالکیہ زمین کے اعتبار سے فرق کرتے ہیں: کھیت اور باغ جو چراگاہ نہ ہوں وہاں مویشی چھوڑنا جائز نہیں، اور جو نقصان وہ رات یا دن میں کریں اس کے مالکان ضامن ہیں؛ اور اگر لوگوں کی عادت ہو کہ وہاں مویشی چھوڑتے ہوں تو اہل مویشی پر ضمان نہیں۔ کبوتر، مرغی اور مکھی کے بارے میں مالکیہ کی دو روایات ہیں: ایک شافعیہ کے موافق، دوسری کہ وہ مویشی کی طرح ہیں، یہ ابن القاسم کی روایت ہے، اور ابن عرفہ نے پہلی کو درست کہا۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2182}\nصاحب التاج و الاکلیل کے مطابق اگر کوئی شخص اپنی زمین میں آگ یا پانی چھوڑے اور وہ پڑوسی کی زمین تک پہنچ کر کھیتی تلف کرے تو زمینوں کے قرب و بعد کا اعتبار ہے؛ قریب ہو تو ضمان ہے، دور ہو تو نہیں، الا یہ کہ آگ ہوا وغیرہ سے پہنچی ہو۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2182}\nحنفیہ کتے اور جانور میں فرق کرتے ہیں: کتا بغیر ہانکے چھوڑا جائے تو جو نقصان کرے اس کا ضمان نہیں، کیونکہ وہ متعدی نہیں اور اس کا پیچھا ممکن نہیں؛ جانور فوراً نقصان کرے تو ضمان ہے، کیونکہ راستے میں چھوڑنا تعدی ہے جبکہ پیچھا ممکن تھا، اگرچہ ابو یوسف فرق نہیں کرتے۔ درمختار میں ہے کہ جو پرندہ، جانور یا کتا چھوڑے اور نہ ہانکے، یا جانور خود چھوٹ جائے، تو دن ہو یا رات، ضمان نہیں، کیونکہ نبی کا قول ہے: «العجماء جبار» یعنی چھوٹے جانور کا نقصان ضائع ہے۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2182}\nپانی کا حکم اس کی مقدار اور زمین کی نوعیت پر ہے: اگر کوئی اپنی زمین میں پانی چھوڑے جو دوسرے کی زمین میں چلا جائے، تو اگر اس کی زمین اسے سنبھال سکتی تھی تو ضمان نہیں، اور اگر زیادہ چھوڑا تو ضامن ہے۔ جو شخص نہر میں مٹی ڈال کر پانی روکے اور کسی کا محل ڈوب جائے، تو ضمان مٹی ڈالنے والے پر ہے، مرسل پر نہیں، کیونکہ وہ متعدی ہے۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2182} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2183}\nحنابلہ مالک کی زہری سے، زہری کی حرام بن سعد بن محیصہ سے روایت پر استدلال کرتے ہیں: براء کی اونٹنی ایک قوم کے باغ میں داخل ہو کر نقصان کرگئی، تو نبی نے فیصلہ کیا کہ مال والوں پر دن میں حفاظت لازم ہے اور رات کا نقصان ان پر ضمان ہے۔ حنابلہ اسے کھیت اور چراگاہ والے مقامات تک محدود کرتے ہیں؛ جہاں چراگاہ نہ ہو وہاں بغیر محافظ جانور چھوڑنا جائز نہیں۔ حارثی حنبلی نے عادت کا اعتبار کیا، تو مالک پر رات کے نقصان کا ضمان ہوگا اگر وہ حفاظت میں کوتاہی کرے۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2183}\nحنابلہ کے نزدیک جو شخص شکار چھوڑ کر کہے «میں نے تمہیں آزاد کیا» تو اس کی ملکیت زائل نہیں ہوتی، جیسے اونٹ یا گائے چھوڑنے سے ملکیت زائل نہیں ہوتی۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2183}\nقبضے اور معزولی میں ارسال: سرخسی کہتے ہیں کہ جو شخص کوئی چیز خریدے اور پیغامبر کو قبضے کے لیے بھیجے تو جب دیکھے اسے خیار ہے، کیونکہ پیغامبر کا دیکھنا اور قبضہ مرسل کو مال پر لازم نہیں کرتا، مقصد عاقد کو معقود علیہ کی صفات کا علم ہے۔ اگر وکیل بنایا اور اس نے دیکھ کر قبضہ کیا تو ابو حنیفہ کے نزدیک مؤکل کا خیار نہیں؛ ابو یوسف اور محمد کے نزدیک ہے، کیونکہ قبضہ فعل ہے اور پیغامبر و وکیل اس میں برابر ہیں۔ ابو حنیفہ کی دلیل یہ ہے کہ مطلق قبضے کی وکالت وکیل کو اسے مکمل کرنے کا اختیار دیتی ہے، اور قبضہ سودا مکمل ہونے کے بعد ہی مکمل ہوتا ہے، جبکہ پیغامبر کا کام صرف پیغام پہنچانا ہے؛ سورۃ الانعام کی ایک آیت (66) سے استدلال کیا گیا ہے جو نبی سے وکالت کی نفی اور رسالت کا اثبات کرتی ہے۔ عیب کا خیار وکیل کے قبضے سے ساقط نہیں ہوتا۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2183} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2184}\nاگر کوئی شخص اپنے وکیل کو معزول کرنے کا پیغام پیغامبر کے ذریعے بھیجے اور پیغام پہنچ جائے تو وکیل معزول ہو جائے گا، خواہ پیغامبر عادل ہو یا نہ ہو، چھوٹا ہو یا بڑا، کیونکہ پیغامبر مرسل کا قائم مقام اور اس کا ترجمان ہے۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2184}\nارسال سے رجوع: حنفیہ کے نزدیک مرسل اپنی بھیجی ہوئی بات سے رجوع کر سکتا ہے، کیونکہ پیغام زبانی نہیں ہوتا اس لیے اس میں رجوع کا احتمال ہے، پیغامبر کو معلوم ہو یا نہ ہو؛ بخلاف وکیل کے کہ اس کی معزولی بغیر علم کے درست نہیں۔ ابن حجر ہیتمی نے ابن سریج سے نقل کیا کہ جو شخص صدقہ پیغامبر کے ساتھ بھیجے پھر راستے میں واپس لے لے تو اسے حق ہے، اور اگر وصول سے پہلے مر جائے تو وہ اس کا ترکہ ہوگا۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2184}\nارسال بمعنی تسلیط: شکاری کتے یا تربیت یافتہ جانور کو چھوڑنا؛ اگر وہ مالک کے چھوڑنے پر شکار کے پیچھے جائے اور اس کے حکم پر رک جائے تو شکار حلال ہے، خواہ ذبح کا موقع نہ ملا ہو؛ اگر وہ خود چھوٹ کر شکار کرے تو ذبح کا موقع ملے بغیر نہیں کھایا جائے گا، کیونکہ اس نے اپنے لیے شکار کیا نہ کہ مالک کے لیے۔ شکار کے احکام اس کے مصطلح میں ہیں۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2184} {cite:fiqh-mawsua-kuwaitiyya-noor-v3 p.2185}\nارسال بمعنی تخلیہ: فقہاء متفق ہیں کہ احرام والے کے ہاتھ میں جو شکار ہو اور وہ احرام سے پہلے اس کے پاس تھا، اسے چھوڑنا واجب ہے، اور اسی طرح غیر محرم جو حل میں شکار کرے اور حرم میں لے آئے۔ گھر یا پنجرے میں شکار ہو تو چھوڑنا واجب نہیں، اگرچہ حنفیہ کے صحیح قول میں اختلاف ہے۔ ہدایہ (حنفی) میں مختلف رائے ہے کہ صحابہ احرام باندھتے تھے اور ان کے گھروں میں شکار اور پالتو پرندے ہوتے تھے مگر ان کے چھوڑنے کا ذکر نہیں؛ اور اگر پنجرہ ہاتھ میں ہو تو ایسے چھوڑے کہ ضائع نہ ہو، جیسے گھر میں رکھ دے، کیونکہ مال ضائع کرنا منع ہے۔ {cite:fiqh-mawsua-kuwaitiyya-noor-v3
