Intishar (spreading; erection, and spreading of a report)

الانتشار

Intishar in the lexical sense is spreading or extending. The jurists use it in two senses: the stiffening of the male member and the spreading of a thing. 1 The first matters for whether a triply divorced woman becomes lawful to her former husband after another marriage, and for compulsion to fornication; the second matters for proof of the new moon by a widely spread report. 12

Definition

Intishar in the lexical sense is spreading; a report that spreads is "intashara", and the day that extends is "intashara". 1

Two senses in fiqh

  • The stiffening of the male member. 1
  • The spread of a thing, as the new moon is proven by a widely spread report. 2

Effects of the first sense

  • A triply divorced woman may be lawful again to her first husband only after a marriage and intercourse in which the member has stiffened, following the hadith of the wife of Rifa'a. 1
  • Whether compulsion to fornication carries the hadd penalty is disputed: the Hanbalis and some Malikis require it, the preferred Shafi'i view does not, since the stiffening may be natural and not willed. 2
  • Rulings on wudu, ghusl, fasting, looking at a stranger and marriage bars by nursing depend on it. 2

Difference

Istifada is used only of reports; intishar applies to reports and to other things. 1

Ahliyya (legal capacity: to have rights and duties, and to act; its stages from the womb to full maturity, and what impairs it)

Ahliyya is lexically suitability, and it is of two kinds: capacity to have rights and duties, the capacity of liability; and capacity to act, that is to perform acts recognised by the law. Its bearer passes through the stages of the foetus, childhood, discernment, puberty and maturity. Liability is complete from birth and incomplete for the foetus; the capacity to act is partial at discernment and full with puberty and reason. It is affected by heavenly impediments such as madness, imbecility, sleep, fainting, illness, slavery, menstruation, childbirth and death, and by acquired ones such as ignorance, drunkenness, jest, folly, travel, error and coercion.
