الإنهاء

Inha is lexically informing and reporting, as one says ‘I informed the ruler of the matter’, and also completing and finishing. ¹ The Malikis and Shafi'is use it to mean informing another judge of one's ruling so that he may carry it out, or of what has come before one short of a ruling, such as a claim heard so that the other may complete it; this may be done in person, by letter, or before two witnesses. ¹

انہاء لغت میں خبر دینے اور پہنچانے کو کہتے ہیں، اور مکمل کرنے کے معنی میں بھی آتا ہے۔ ¹

حکم

مالکیہ اور شافعیہ کے نزدیک قاضی کا دوسرے قاضی کو اپنا فیصلہ یا دعوی کی کارروائی سے آگاہ کرنا تاکہ وہ اسے نافذ یا مکمل کرے۔ ¹

الأهلية

Ahliyya is lexically suitability, and it is of two kinds: capacity to have rights and duties, the capacity of liability; and capacity to act, that is to perform acts recognised by the law. Its bearer passes through the stages of the foetus, childhood, discernment, puberty and maturity. Liability is complete from birth and incomplete for the foetus; the capacity to act is partial at discernment and full with puberty and reason. It is affected by heavenly impediments such as madness, imbecility, sleep, fainting, illness, slavery, menstruation, childbirth and death, and by acquired ones such as ignorance, drunkenness, jest, folly, travel, error and coercion.
