Definition
Akdariyya is one of the named problems in the shares of inheritance. Its heirs are a husband, a mother, a paternal grandfather and a full or paternal sister. 1 It is named after a woman of the Banu Akdar whose estate raised the problem, after a man of that tribe who answered it wrongly before Abd al-Malik ibn Marwan, or because it troubled Zayd ibn Thabit's principles. Iraqis call it al-Gharra'. 1
The three positions
- Zayd ibn Thabit, followed by the Shafi'is and Hanbalis: the husband takes half, the mother a third, the grandfather a sixth, and the sister half. The grandfather's and sister's shares are combined and divided between them, a male taking twice a female. The base of six rises to nine and the case is settled from twenty-seven. 12
- Abu Bakr and Ibn Abbas, followed by Abu Hanifa: the husband half, the mother a third, the rest to the grandfather, and the sister drops out. 1
- Umar and Ibn Mas'ud: the husband half, the sister half, the mother a sixth, the grandfather a sixth; the base is eight after the increase. 2
Related named cases
Without a husband the case is called al-Kharqa'; without a grandfather it is al-Mubahala; without a sister it is one of the two Gharrawain. 2
