Compulsion (ijbar)

إجبار

Ijbar in the lexicon means compulsion or coercion. Jurists gave it no separate definition, and their use does not depart from the lexical sense. 1 Lawful compulsion includes a judge forcing a stubborn debtor to pay, a guardian's power to marry off one under his care, such as a young girl, and the compulsory taking of property for public benefit. 1 2 Lawful compulsion does not void the transaction, and it may be automatic and without request, as in compulsory set-off. 2 Other cases include forcing a hoarder to sell when he refuses the ruler's order, taking from a state official what he gained by his office, and the ruler's prohibition of marriage to Christian women for senior Companions, as reported. 3

Summary

In the lexicon, ijbar means compulsion or coercion: one says ajbartuhu 'ala kadhā when one forces a person to do something. Jurists gave no separate definition, and their use keeps this sense. 1

Examples of lawful compulsion

Whoever holds the power of compulsion over marriage may marry off a person under his care, such as a young girl or a mentally incapable woman. A preemptor takes the property he has the right to preempt against the buyer's will. A judge may force a debtor who stalls to pay. 1 2 Compulsion may be lawful and even required; it need not involve threats; it may come from the compeller's act or word; and it may be automatic and without request, as in compulsory set-off. 2

Effect on the transaction

Lawful compulsion does not void the transaction. It need not be unpaid service: the consideration still applies. 2

Other cases

A hoarder may be forced to sell when he refuses the ruler's order. Property an official gained by his office is taken from him by force, as 'Umar did with his agents. 3 The ruler's prohibition of senior Companions from marrying Christian women, and his separation of some of them from their Christian wives, is also cited as an instance. 3

Matters treated in their own places

The entry also mentions compulsion to maintain a wife, children and relatives, custody of a child, and the rights of the upper and lower floor owners to rebuild a collapsed ceiling. Each is treated in its own place. 4 5 6

Biting and the liability for injury it causes (add)

In the lexicon, add is gripping a thing with the teeth and holding it. If a person bites another without right and a wound results, the biter must pay the damages for the wound, assessed as a just award by experts. If one man bites another's hand and the bitten man pulls it free so that the biter's front teeth fall out, most jurists hold that there is no liability, relying on a prophetic judgement in such a case; the Shafi'is limit this to a bitten man who chose the easiest means of release, and the preferred Maliki view requires compensation.
