Summary
Liwat, in lexicon, is the verbal noun of the root for acting as the people of Lot did; in technical use it is the insertion of a male's member into the anus of a male or a female 1. The jurists agree it is forbidden and one of the gravest abominations; the Qur'an condemns the people of Lot in surat al-A'raf and surat al-Shu'ara, and a hadith curses one who does their deed 2. The schools differ on its penalty: most apply the penalty of unlawful intercourse, Abu Hanifa applies discretionary punishment, and the Malikis stone both parties 3.
Related term: unlawful intercourse (zina)
Zina is lexically debauchery; the Hanafis define it in the wider sense as a man's intercourse with a woman in the front passage outside ownership or its semblance, and the Shafi'is as inserting the male member into a forbidden front passage, free of doubt and naturally desired 1. Liwat and zina agree that both are forbidden intercourse; the difference is that liwat is in the rear passage and zina in the front 2.
The ruling
The penalty for the doer
Most jurists hold that the penalty for the doer is that of the adulterer: the married person is stoned, another is flogged and exiled, since it is zina; they rely on verses and on the hadith of Abu Musa, 'If a man mounts a man, both are adulterers' 2; the schools add distinctions 2. Abu Hanifa holds that the hadd is not due for intercourse with a non-wife woman in the rear passage nor for liwat, but discretionary punishment is due; Abu Yusuf and Muhammad say liwat is like zina, flogging if unmarried and stoning if married; in the Hanafi school's preferred view, one who repeats it is killed 2. For one who does it to his own slave, female slave or wife, the Hanafis agree no hadd is due, only discretionary punishment 2.
The schools on the penalty
The Malikis hold that the doer and the one acted upon are both stoned, married or not, if they are legally responsible; Islam and freedom are not required of them. A man's intercourse with his wife or female slave is not hadd, only discretionary punishment 4. The Shafi'i school's preferred view is that the hadd of zina applies to the doer; one view is that the doer is killed whether married or not, on the hadith of Ibn Abbas, 'Kill the doer and the one acted upon'; another view is that discretionary punishment alone is due 4. The one acted upon, if a minor, insane or coerced, is not liable to hadd; if a responsible free chooser, he is flogged and exiled, married or not, and one view has a married woman stoned 4. Intercourse with one's wife or slave-woman in the rear passage carries discretionary punishment if repeated, and none if not repeated 5. The Hanbalis hold the hadd for both parties is that of the adulterer, since the rear is a sexual organ like the front; there is no difference between one's own slave and a stranger 4. Intercourse with a wife in the rear passage is forbidden and carries no hadd, only discretionary punishment for the sin 4.
