Who gets compensation for late shipping: the intermediary or the customer?

لمن يكون تعويض تأخر الشحن: للوسيط أم للزبون؟

A question from an intermediary for an online shop who pays in advance for customers' orders, where the shop offers a refund as compensation for late shipping, in which Jordan's General Iftaa Department answered that the refund belongs to the customer if the intermediary acts as the customer's agent, and to the intermediary if she buys the goods for herself and then sells them. The Department answered that the ruling depends on the nature of the contractual relationship between the intermediary and the customers. It said that if the intermediary is an agent who delivers orders and takes a delivery fee and an agency commission, the rule that an agent acts for the principal's benefit applies, so the agent may not keep any cash refund from the supplier, and the refund belongs to the customer. If the intermediary buys the goods with her own money and then sells them to customers, she may keep the refunds, because the goods entered her ownership and risk before she sold them. It concluded that the refund belongs to the customer when the intermediary is the customer's agent in buying and delivering, and to the intermediary when she buys the goods for herself and then sells them.

The question

The questioner said she works as an intermediary for an online shop, ordering products for customers and paying for them in advance, then collecting the money from customers on delivery; because shipping is sometimes delayed, the shop offers to refund the amount paid as compensation. She asked whether the compensation is hers or the customers'. 1

An agent paying his principal's zakat from his own money and reclaiming it

A question whether an agent may pay his principal's zakat, with the principal's permission, out of his own money and then reclaim what he paid; Jordan's General Iftaa Department answered that zakat is a purely financial act of worship in which agency is permitted because its purpose is the payment of property, quoting al-Bujayrimi in Tuhfat al-Habib on the division of acts of worship into purely bodily ones in which agency is barred, purely financial ones in which it is allowed without restriction, and mixed ones such as hajj in which it is allowed on condition, and al-Nawawi in al-Majmu that the zakat payer may appoint an agent to hand it to the ruler or to distribute it to the eligible categories, without disagreement, and that agency to pay it from the principal's money or from the agent's own is permitted without disagreement, since it resembles the settling of debts and need may call for it when the property is absent; if the agent pays from his own money, his intention at the time of payment is required for it to count and the principal's intention does not suffice, as Ibn Hajar al-Haytami says in Tuhfat al-Muhtaj. It concluded that the zakat payer may appoint another to pay his zakat, that the agent may pay it from his own money and then reclaim what he paid from the payer, on condition of the agent's intention at the time of payment.
