إثم

إثم

In the lexicon, ithm means sin, or doing what is not lawful for one. For the Sunnis it is the deserving of punishment; for the Mu'tazila it is the necessity of punishment. The difference turns on whether forgiveness is possible. 1 Sin attaches to abandoning an individual obligation, such as prayer, and to abandoning a collective obligation when all leave it, such as the funeral prayer. 1 Doing what is forbidden is sinful; doing what is disliked as a matter of preference carries no sin, and doing or leaving what is permitted carries none. 2 The Hanafis, Malikis and Hanbalis hold that a fixed penalty does not remove the sin in the hereafter; al-Shafi'i holds that it purifies a Muslim but not a non-Muslim. 2

In the lexicon, add is gripping a thing with the teeth and holding it. If a person bites another without right and a wound results, the biter must pay the damages for the wound, assessed as a just award by experts. If one man bites another's hand and the bitten man pulls it free so that the biter's front teeth fall out, most jurists hold that there is no liability, relying on a prophetic judgement in such a case; the Shafi'is limit this to a bitten man who chose the easiest means of release, and the preferred Maliki view requires compensation.
