الانتقال

Intiqal in the lexical sense is moving from one place to another, and used figuratively for a change of state. ¹ A duty passes to its substitute when the original cannot be done: ablution to tayammum, standing to sitting, fasting to a ransom, a debt to its value. ¹² Some rights pass to heirs and others do not, depending on whether they concern property or the person of the deceased; a rule also passes, as a waiting period passes from divorce to widowhood. ²³⁴

انتقال لغت میں ایک جگہ سے دوسری جگہ جانے کو کہتے ہیں، اور مجازاً حال کی تبدیلی کو بھی۔ ¹

حکم

اصل کی ادائیگی ممکن نہ ہو تو واجب بدل کی طرف منتقل ہو جاتا ہے، جیسے پانی نہ ملنے پر تیمم، اور کھڑے ہونے کی طاقت نہ ہو تو بیٹھ کر نماز۔ ¹

اقسام

حقوق کی منتقلی: جو حقوق مال سے متعلق ہوں وہ وارث کی طرف منتقل ہوتے ہیں، اور جو شخص کی ذات اور ارادے سے متعلق ہوں وہ منتقل نہیں ہوتے۔ ³⁴
عدت کی منتقلی: طلاق کی عدت میں شوہر کا انتقال ہو تو وفات کی عدت میں منتقل ہو جاتی ہے۔ ⁴

الأهلية

Ahliyya is lexically suitability, and it is of two kinds: capacity to have rights and duties, the capacity of liability; and capacity to act, that is to perform acts recognised by the law. Its bearer passes through the stages of the foetus, childhood, discernment, puberty and maturity. Liability is complete from birth and incomplete for the foetus; the capacity to act is partial at discernment and full with puberty and reason. It is affected by heavenly impediments such as madness, imbecility, sleep, fainting, illness, slavery, menstruation, childbirth and death, and by acquired ones such as ignorance, drunkenness, jest, folly, travel, error and coercion.
