Overview

The school of Malik ibn Anas, author of the Muwatta'. Ahmad Amin counts it the third of the schools in its use of opinion, after the Hanbalis and the Zahiris. 3

Istislah

Among the tools of the school is "istislah", or "unrestricted public interest" (al-maslaha al-mursala), which rests on the principle that the lawgiver's legislation turns on preserving five things: religion, life, reason, progeny and property. 4
