Must al-Fatiha be recited in every rak'a of the prayer?

Ideas Living

هل تتعين قراءة الفاتحة في كل ركعة من الصلاة؟

In al-Jami' li-Ahkam al-Qur'an al-Qurtubi sets out the jurists' disagreement on al-Fatiha: Malik and his school require it of the imam and the one praying alone in every rak'a; al-Hasan al-Basri and most Basrans hold once in the prayer suffices; Abu Hanifa, al-Thawri and al-Awza'i allow other Qur'an in its place; al-Tabari requires an equal substitute; al-Qurtubi prefers that it is required in every rak'a.

Summary

In the second chapter of his commentary on al-Fatiha, 'on its revelation and its rulings', al-Qurtubi sets out twenty questions, among them whether reciting it in the prayer is required. 1 He quotes the jurists' views from Ibn Abd al-Barr's al-Tamhid and al-Istidhkar and other works, then gives his preference. 2 3

What is agreed

Al-Qurtubi reports the scholars' agreement that there is no prayer without recitation 4, and rejects the report that Umar prayed the sunset prayer without reciting and asked 'how were the bowing and prostration?' as a report of objectionable wording and broken chain. 4 He also reports a narration from Malik that recitation is required in no part of the prayer — which some of Malik's followers call objectionable — and that al-Shafi'i held something similar in Iraq about one who forgot it, then withdrew it in Egypt. 5 4

Al-Qurtubi's argument

He cites Ibn al-Arabi: the negation in 'there is no prayer for one who does not recite al-Fatiha' can be read as denying completeness or validity, and the stronger reading is the general one, so the stronger narration from Malik is that the prayer of one who does not recite it is void; and whoever reads the words 'do this in all your prayer' as applying to it must repeat the recitation in each rak'a as he repeats the bowing and prostration. 6

recited in every rak'a, and if omitted only an equal amount suffices; Ibn Abd al-Barr rejects this 3.

al-Tamhid li-ma fi al-Muwatta' min al-Ma'ani wa-al-Asanid

Ibn 'Abd al-Barr of Cordoba's (d. 463 AH) book on the hadiths of the Muwatta' in the recension of Yahya b. Yahya al-Laythi: it gathers every report from the Prophet in the Muwatta' — connected, broken and mursal — arranges them under Malik's teachers in alphabetical order, supplies connected chains from outside Malik's route, and expounds meanings, rulings and the jurists' views, so that it became a classic of comparative fiqh; Ibn Hazm said he knew nothing like it on the fiqh of hadith, and its author spent over thirty years revising it, leaving two recensions.
