Arba'un 39 — God pardoned my community error and forgetfulness

الأربعون 39 — تجاوز الله عن أمتي الخطأ والنسيان

The hadith of Ibn Abbas that the Messenger of God said: 'God has pardoned for my sake on behalf of my community error, forgetfulness, and what they were coerced into' — the thirty-ninth of al-Nawawi's Forty and of Ibn Rajab's commentary, graded hasan by al-Nawawi, narrated by Ibn Majah and al-Bayhaqi among others; Ibn Majah (2045), al-Uqayli, al-Tabarani and al-Bayhaqi transmit it through al-Awza'i from Ata' from Ibn Abbas, while Ibn Hibban, al-Daraqutni and others carry al-Awza'i from Ata' from Ubayd ibn Umayr from Ibn Abbas — an isnad sound in appearance whose narrators are all relied upon in the two Sahihs, and al-Hakim declared it sound on their condition; yet it has a hidden defect, for Imam Ahmad repudiated it vehemently, saying it is only transmitted from al-Hasan from the Prophet as a mursal, and when told that al-Walid ibn Muslim narrated its like from Malik from Nafi' from Ibn Umar he repudiated that too; and Abu Hatim al-Razi was presented with al-Awza'i's hadith, Malik's hadith, and al-Walid's route from Ibn Lahi'a from Musa ibn Wardan from Uqba ibn Amir (Jami' al-Ulum wal-Hikam pp. 796–809).

Compulsion (ikrah)

Compulsion in Ibn Abbas's hadith — the thirty-ninth of the Forty — is the third thing God lifted from the community: 'and what they were coerced into' — another's forcing one, by credible threat, into a deed or utterance; its rulings in the commentary differ by subject: in the word of unbelief it was excepted by His saying 'except one compelled while his heart is at rest in faith', and in transactions and utterances it affects validity and bindingness, the unifying principle being that compulsion removes deliberate assent so the ruling does not settle upon its subject as it settles on the willing actor (Jami' al-Ulum wal-Hikam p. 796).
